Key legal remedies of trademarks in Germany
The trademark’s owner have a right to:
1) bring the objection against the controversial registration;
2) entitle to a court’s prohibition against the using of an identical or similar trademark;
3) bring a claim against the infringer for compensation of the damages incurred;
4) demand from the infringer the elimination of unlawfully marked goods, raw materials and equipment;
5) demind information on the quantity, delivery dates, prices, sources of procurement and channels of distribution of unlawfully labelled goods (services);
6) initiate of criminal proceedings on suspecting a willful infringement of the exclusive right to a trademark.
Russian assets => German last will
For various reasons, the Germans received real estate, company shares, securities, cars, etc. in the Russian Federation. Travel to Russia and back has been made more difficult for two years. Any German can bequeath assets located in Russia through a last will (testament) drawn up in Germany. In the inheritance case, the real estate is processed in accordance with Russian law (estate split). Proof of the status of heir is provided by an act - “Certificate of inheritance rights”, which is drawn up by a Russian notary upon the written application of one or more successors.
